Shock jock Howard Stern sued ABC and the producers of the reality series Are You Hot? claiming the show is based on his ideas that aired on his radio program and it ruined his chances for his own TV deal.

The lawsuit, filed Thursday in Superior Court, accuses the network of copying the "unique aspects" of a Stern radio segment in which members of his crew and guests evaluate the bodies of in-studio contestants.

Stern claims that some of the tactics used on his show were duplicated by ABC's version. Some of the alleged similarities include blunt criticism of contestants and the use of a laser pointer to highlight areas of the contestant's body.

Are You Hot? features contestants in various stages of dress posing in front of a three-judge panel who rate them solely on looks. The show is produced by Scott Einziger, a former executive producer of Stern's E! cable show. Former Stern sidekick Jackie Martling is listed as a consultant for the show.

Before the ABC show debuted, Stern was in talks to develop a TV series based on his radio segment, according to the suit. He planned to broadcast the show possibly on a pay-cable channel that wouldn't be subject to censorship.

But when ABC aired Are You Hot? talks for a Stern TV show collapsed, the lawsuit said.

The lawsuit said Stern warned the network that the series would be a "misappropriation," but that ABC disregarded him.

Stern is seeking $100 million in damages.

I listen to the show now and then and I do recall him talking about making a Pay-Per-View with hot chicks being judged on their looks. He wanted it on that format, because he would'nt have to worry about sensorship. $100 million is a bit much, but I'm sure ABC is making that much in advertising.

I don't remember him talking about the 'Are you hot?' show when I listen to him, this is news to me since I listen to him almost everyday.

I love the show and all but this is odd to hear, especially the Jackie/Einziger involvement. Ah well I hope he wins the suit, everyone else seems to steal alot of his ideas("It's Just Wrong" and even his interview with Fred Durst about Britney)

Why the fuck is Howard Stern still around in the media industry? The only folks who even give a shit about him are the hangers-on for him show.

O & A would rip on him during his divorce (and on other occasions as well). He threw a hissy fit and because he's higher up in the same company (Infinity Broadcasting) they made O & A stop talking about him.

I thought that the Hot or Not website people were suing ABC.

It seems the suit is valid, in which case Stern is entitled to some kind of compensation - large enough to dissuade television channels from ripping off more ideas.

I'm telling you, the networks are starving for ideas. Their programming departments should be purged of idiots. You can quibble about isolated incidents all you want, but Stern is a real talent that so many others have ripped off. I doubt there's anyone with half his brain at ABC.

That said, I wish crap like that show would stay on the radio and late-night cable.

I like Howard Stern. Last summer and the summer before, his radio show always brightened up by horrible, dull commute. It's genuinely funny, and in recent years he has somewhat cooled it on the "bring in the porn star or lesbian and have them make out and get naked" stuff. His interviews are genuinely good, and he usually asks questions that no one else would. I remember Dick Clark called in and he started asking questions about the guy's bidet. :)

Sorry for being OT, but people give Stern too little credit.

Not really. I wasn't a fan of his until a couple of years ago and now it's better than ever without Jackie. Artie Lange takes his place and is a hell of alot funnier with his witty retort. He's awesome man, as diffusion said, he brings alot of cheer into my daily school commute and makes me laugh in front of everyone making me look like a lunatic fuck if I care though. ;)

All ABC needs to do is argue that they got the idea from the website and they stand a good chance of winning. Fuck Stern, he's an ass. His show has gotten monotonous and drab, he's a fucking has-been.

Stern is very entertaining and funny, and I agree with everything you said, except for the "toning down of the porn star making out stuff". Didn't you hear the recent "Lesbian dial-a-date" where be brought in porn star Tabitha Stevens, who was completely naked during the entire contest, and who made out with (and more) with the four contestants? :)

I watched that on the E! show the other night, Tabatha was pretty hot, but only two of the four lesbians were cute.

Just for the record, that was the 3rd Sex for Sam contest that O & A held, and that year the show had never been bigger. They were destroying everyone in the ratings and more than a few people hated their guts. Stern does a terrible radio show.

It all feel apart for Stern in my eyes after his divorce and after jackie split. It was bad enough for him to come off as an every-day joe making all the dough he has, but now with a model gf, a Manhattan apt and a mansion to be built in Long Island?

He's complacent because he has what he's always wanted. What can he possibly bitch about that won't have ppl think he's throwing a bitch hissy fit?

This isn't the first time that ideas have been stolen from him. The whole "Politically Incorrect" (The Bill Mahr Show) was originally his idea, and the Hot or Not thing as well. I guess he just had enough of people stealing his ideas. It's not like the law-suit isn't valid.

And diffusion is right. You people give him too little credit. He's been on the air for quite awhile, is basically the icon of the radio industry, and has a very successful movie based on his life. Not to mention that his show is consistenly funny. How many other radio personalities can say this?

Plus, the cartoon about his childhood that he's coming out with in about a year sounds like it'll be pretty good.
