Well I went to exchange the 2nd disc today without the reciept. The guy who was there when I bought it was working and he didn't even ask for the reciept. I guess I got pretty lucky.

It seems most EB's only have about 2-3 employees in them, anyways, lol.
Hey.. wait a second. He exchanged your cd, but did he put the defective cd into the other Lunar 2 game? That's pretty low if he did.
No it isn't. Out of sight of the customer, what should have happened is a pink defective slip comes out, gets taped to the box, gets filled out with the relevant info, and then gets dumped in a box out back, to be dealt with in the appropriate manner. 2x4 to the head of anyone stupid enough to try to resell it when there's absolutely no reason to.
I know I'm pretty lenient on the receiept thing. Official policy (storewide) is that if it makes the customer happy it can be done. There's limits, no way could you have gotten cash back with no receipt, but an even exchange isn't really a problem. Exception to the rule- customer acts like a self-obsessed imperious asshole. Then instead of relenting we apologize for there being nothing we can do. :)

yup. that's pretty much it.
I allow exchanges for games w/o receipt if it's in sellable condition and not scratched...or offer them to get something they want by issuing trade-in credit of the game. This especially applies when they didn't even buy the game from any of our stores.
I always resold games that "didn't work". 90% of the time they didn't come back.
