Surely there must be protection against this in the 4th Amendment (unreasonable search & seizure).
Even though I don't do P2P, the thought of some third parties snooping is downright anger inducing and justifies boycotting. Hopefully those who face RIAA in court will play the US&S card.

They can't do anything to you if you're downloading from them...that's entrapment. And they can't monitor a connection between you and another user (neither of which are RIAA/MPAA) because that's illegal as well.
