TOKYO--Mainichi Interactive reports today that game publisher Tecmo has won another decision in a long-standing legal battle concerning its Dead or Alive franchise. The Supreme Court of Tokyo has ruled that a small software publisher called Westside infringed upon Tecmo's copyright when it released a utility that allowed PlayStation 2 owners to remove the clothes from the character Kasumi when they played Dead or Alive 2.

Two years ago, the district court of Tokyo also found Westside to be in infringement of Tecmo's copyright. Westside appealed the decision to the Supreme Court of Tokyo. The decision of the Supreme Court was no different from that of the district court, ruling that Westside was "causing violations of copyright laws by allowing purchasers to use the [hacking] software."

The verdict against Westside was small on its face--the company must pay only two million yen ($18,205) in damages--but the financial damage may actually be worse, considering how much the company had spent on its legal fees up until now. Westside continues to operate in the video game data-hacking business, releasing tools that can modify or extract data from various games. The company sells its utilities by way of a bimonthly periodical “Otanoshimi CD," as well as through its corporate Web site.

The outcome of this case might have been completely different in the United States. In the early '90s, American courts continually upheld the right of Lewis Galoob Toys to produce its Game Genie accessory, which let Nintendo Entertainment System users alter their video games in a similar, temporary manner. Nintendo asserted that the device infringed upon its copyrights, but the courts did not agree.

The reason it was only Kasumi was because the hack was a simple model swap, and she was the only character in the game with a naked model. It just let you play as the model from the intro (the one sans nipples) in the main game. You could do something similar with the DC version(s), except swapping in the naked model would not work as the cutscene models were a different format for the DC builds (and made the game crash if you tried them).

The reason you got nude models in DoA:XBV and DoA3 was that the texture format they used in that game was a well-known one (some derivative of the standard DirectX texture format), and people spent the time adding the key bits themselves. So if you want hot hot naked Kasumi on Ayane action, you need to grab DoA3.

Dolemite: Ivy has had the ass jiggle since the DC port of SC1, so it is nothing new. I thought there were a couple of other games between there and now that have it too, but I am blanking out. Besides, who in DoA has an ass big enough to move?

Dude, support who you want, but I was just asking how such a mediocre at best game like DOA gets everyone here so hot and bothered. Some people here would bend right over for Itagaki and he's just another developer... with a much shorter resume than most other developers who've been around as long as him. I don't care if he rehashes something, but fuck man, the second, third, and fourth time through you should make some signifigant improvement, not make the tits more realistic. Call me crazy but I like real life tits, not those polygonal ones, and when that's what you're KNOWN for.... well I just think there's tons of people deserving far more respect than him. In summary, I'm glad itagaki can make a game where tits bounce realistically... but I play games to PLAY them, not to drool over some fake anime broad. My two cents I guess... There are just as many Treasure and SNK fanboys here as there are Itagaki ones. Hell, I'd say the latter is outnumbered atleast 2 to 1. One a side scroller, one a fighter, then rehashed each multiple times adding virtually nothing to DOA and I can't really comment on Ninja Gaiden as it's been so long. Miyamotto basically invented the platforming sidescroller, Boroguht the RPG to the mainstream vai a game like Zelda, has made adventure shooters like Metroid, psudeo strategy like Pikmin. The list goes on

Praising a man who has shown that he can turn the industry on its head with an entirely new concept or function in a game on multiple occasions make sense. I've yet sto see Itagaki do that. That's an idiotic statement, hands down. The gaming community doesn't tolerate a paper tiger. Romero made wild claims, delivered a crap product, and now he's the laughing stock of the gaming industry. Itagaki backs up his bragging with quality product that moves units and gets praise from the critics. Miyamoto is the man though. He contributed more to gaming in individual games than all of Itagaki's worked combined. Even the stuff he didn't do first, he still took further and them made into extremely fresh experiences. That's just as important, if not moreso, than being first.
