I agree with you. He did it, but they definitely didn't prove it. I am just glad they didn't cop out and find him guilty of second degree only.

Did you guys see that boat bullshit video?

The defense tried to show that you couldn't dump someone out of the boat he used without tipping. The guy faked having a hard time lifting the girl, then jump out, it was hilarious. Even if it did tip though, he could have just climbed right back in, not exactly the end of the world.
