Boy, did I get dicked over

Dear surrogate livejournal,

I share an apartment with 2 of my friends. I'm the lease-holder, and the both sublet from me. One of them I've known for about 5 or 6 years, and the other (Joe) I've known for about 3. Joe's kind of an irresponsible dude, and he's perpetually been short on the rent for the entire time he's been here, but his debt rarely accumulated much past maybe $200. A pain in the ass, but nothing to get crazy over. Joe and I have worked at the same office for about 2 years. About a month ago he got fired.

Now, Joe's been bad about employment before. He's got no sense about making himself presentable. So I said to him that I couldn't spot him for rent if he wasn't working (mind you, at the time he was fired he owed me $160 and had about $2 to his name). No waiting around on unemployment checks. So he went on some interviews and he told me he got a position at the deli around the corner. Good enough. But since he still owed me back rent, I asked if he could have someone help him out. He talked to his mom, she said she'd wire him the money on March 11 (yesterday). Seemed like he had things under control. I payed the rent on time, like I always do, knowing that Joe would be able to pay me back fully in a timely fashion.

So yesterday, Joe gets his money from his mother. He tells my other roommate that he's leaving to do laundry, and she thinks nothing of it. When I get home from work, I ask where he's been. She says he went to go do laundry in the morning and hasn't been seen since. It was at this point that an awful feeling hit me in my gut.

The next morning he's still not home. I knock on the roommate's door. She says she hasn't seen him. I looked at her and said "Please tell me what I'm thinking is wrong. Please tell me I'm being paranoid." It was then that I noticed that his computer was also gone, and his keys were on the table.

I was had. To the tune of $650. He skipped town without a trace. What's worse, if I can't find someone else to pick up his sublease, I could lose my apartment, and my security deposit.

I considered this guy my friend. Shows what I get for putting that kind of trust in some one.

Your "friends" will always fuck you over hardest.

You got his full name, social security number or anything else on his profile? There's ways he can be tracked down if you have the resources to do so. You may need to press charges on evading rent so he caughs up what he still owes.

I've seen situations like this on those court shows. I don't see how you can't get what he owes if you're willing to go after it. Granted, I have no idea if courts costs and all that are more trouble, but chances are he'd owe for the month, whatever he owed you before, and for the next month since he didn't give 30 days notice.

If experience is any indicator, it will be tough. Not impossible, but with the short time frame, it's not going to be easy. It's a nice place, in a great location, and at a good price, but it took us a month to find someone last time, and that was prime renting season.

Two hard lessons that I've learned over the past year and it involved the person I thought I could trust the most - my future ex-wife. Take him to small claims court - you won't need a lawyer to do so, most likely. Good luck.

This is why security deposits exist.

I would file in small claims court. If he doesn't answer the summons, you'll win by default, and this will follow him around for the rest of his life.

Also...if he changes his address at the post office, I believe a notification of the change will be sent to his old address. IE yours.

He has, indeed, filed for unemployment. They sent some kind of packet here (which I no longer have), but I don't know about any checks just yet. I wouldn't be able to cash those anyway, though, so what good does that do me?

EDIT: I found a pay stub of his. It has a bank account number, but nothing really useful like a social security number. It has the last 4 digits only.

If you have his checks, he's gonna come looking for them at some point.

And if he changes his address, you might find out about that, too.

In the meantime, I'd worry more about filling the room.

Yeah, I gave $200 to a friend back in high school because he needed the money for car repairs. I graduated from high in 2003. He just payed me now. It is fucking 2006. I especially hate how when people finally fork over the money they owe you, they act like you should be grateful OR act like you're being a pain. I swear, people can be total dicks when it comes to greenback. Money seperates people in the worst ways.

Oh, did I mention that he has a fake green card he bought off of some mexicans at work that he used to buy a cell phone plan that he never intended to pay? "Javier Alva" is his alias.

The same thing happened to a friend of mine. A bunch of guys all share a house and one of them got fired. He just got up and left without any notice. The other three guys in the house are still paying an extra hundred something bucks each to cover his rent. They still haven't found a new roomate in the past four months. Supposedly they're used to it though cause they said roomates always come in and out of there.

It still pretty much sucks. I've never had a roomate I was never really good friends with. Now I live alone cause its just too much work to find someone you can trust as a roomate.

Call his mom and tell her the whole situation. If she's cool about it, offers to help you track him down or (best case scenario) pays his tab for him, great. If she acts like a bitch or seems to be shady, tell her you will be forced to press charges and he'll likely have a warrant issued for his arrest after a while (true or not, as long as you stress it's a possibility not a certainty, it isn't a threat and you're in no danger) then of course his immigration status might come into question, etc., etc.

Odds are, she'll want to keep the police out of this.

Yeah, the flags were there. I knew he was a bum, and as long as he didn't owe me ridiculous amounts I was pretty cool about it. And yes I was bugging him about the situation, or at least I was blunt about the fact that I needed him to at least be able to show me how he was going to be able to pay me, but he wasn't mad about that. I've never even had a fight with the guy about anything. And this was very much a calculated plan, executed over the course of weeks, not a whim.

In hindsight, it's pretty obvious to me that he got fired on purpose, to collect unemployment. He planned this shit out way in advance.

The most, I've come close to losing is about $200, but I kind of had "friends of the family" (actually close friends with my grandfather from way back) who had hired the guy and they just swiped the money he owed me off the top of his next paycheck. He was pissed and threatened lawsuits, but these were the types of "family" you didnt really fuck with. It was really awesome how it played out, and part of me wishes I personally knew people like that who I could sick on your slimeball ex-rommate....or anyone who looks at me funny....

Isn't rent paid in advance for the coming month? And therefore if he left the apt why would he owe rent? His name wasn't on the lease, so if you didn't have a seperate contract of some sort with him i'd say he doesn't owe you. A dick move on his part, but you won't be getting any money out of him if this is the situation.

Ya, as soon as I saw you say you're the name on the lease and they are renting off you basically i knew you were screwed. My brother got caught in this one time. Never have your name as the sole name on the lease unless you are prepared to pay for the entire thing.

Sorry about this whole thing Frog - the #1 reason why I wouldn't be roomies with a friend. I've seen/heard a lot of these horror stories over the past few years.

Because he asked me to spot him while he waited for his mom to send him money. He told me he would pay me back. We had a clearly spelled out agreement with a date and an amount, and it was witnessed by others.

Thank God, for the emergency funds. As far as the money in my account goes, I have like a danger zone I dont like to go below, and save for shitty rainy days like yours. I've been burned by this hard ass life one too many times to not have it. At least you know that you can recoup your losses eventually through legal matters, so that should make you feel a little better.

There is a no way a slob like this will cover his tracks perfectly. Over time, you will get bits and pieces that will help you get your money back.

Still, pretty sleazy running away like that. You're better off not associating yourself with this guy in the long run.

I'm going to school and trying to get back on my feet. It's been a rough 5 years for me (see Medications thread), so it's not like I'm a failure to launch and just trying to get a free ride.

People move out and stay at home for the wrong reasons. Most people move out because everybody else is doing it, and that's a shitty reason for doing anything if you ask me. I've lived on my own for 1 1/2 and it has as many positives as it does negatives, same with living with your folks.

I know a lot people don't live with their parents for the simple fact that they have asshole parents. Who wants to live with people who are drunk and abusive? (On second thought, roomates could be that way too).

I don't see it as a big deal. I know at least 6 people over 25 who live at home. Some of them have excuses like I do, others are druggies or just lazy, a couple go to school. There's more people staying at home than you think, and it's not all otaku and mommas boys.

Besides, I can't afford to live on my own and I'm not even going to pretend I can.

I feel for you as I also have a shitty roomate. She owes 3 months rent (over $3000) and its my name on the lease.

If you're in school and trying to better yourself than no explanation needed. I'm an "ole-man" doing the school thing too, and money gets rough in this phase of life.

If I was really cool with my parents and they lived in town, I'd be making stealth runs to their house to scam food ,washing machine usage,or something off of them every chance I got.

I live with my mom and really hate it. But Im up to my neck in debt from college and starting salaries aint what they used to be. Moving out now = being in debt 5 more years. I plan to be looking a year from now though and hopefully be out by summer 07. I blame George Bush, or something.

I looked for apartments up there a while ago--Boston is just as bad, if not, worse than NYC. Chicago, on the other hand, was pretty reasonable.

1. Boston
2. NYC
3. Miami

I had a lot of trouble renting this place out before, during a MUCH better time of year, so anything to close a deal right now. If I don't find anyone I get dicked out of my security depostit, which is much more than the stupid TV is worth.

No one is moving in because you're giving them a crappy TV and some DVDs.

In the history of rentals, it's never happened.

I'm not likely going to sell them for much either, so fuck it. Can't hurt.

Here's what I talked about earlier:

Friend “A”. Let's call him John. Probably someone I’d consider to be my best friend here. Good guy. Honest. Hardworking. Has a kid (with whom he and the mother share custody). Organized. Responsible. Works for a well known chain of video game vendors (so you know how many hours he has to work per week).

Friend “B”. We'll say Mike. He knew John through someone else in college. Works for a cable company. Unorganized. Likely to quit a job on a whim just because of one minor situation without having a new job lined up first. Shifty. Childish (all of this I wouldn’t find out until later).

John had a dependable roommate for a number of years, but this person got married and moved out. John was by himself (paying a $595 rent) for a few months. Situation was getting dire….I don’t know how many people applied to be a roommate, but he ended up with Mike.

Mike was doing fine for the first few months. He was on time with his side of the utilities and rent. He was in and out of the apartment, a (for the most part) quiet guy, and never bothered anyone. Then, one day he quit his job out of nowhere. He “made friends” with a few guys next door who turned out to be dealing drugs. Even let them into the apartment a few times while John was at work. He quit one cable company and managed to get a job with another cable company, whom he worked with for a few months before quitting (again with no job lined up). His parents came over and CHEWED HIM OUT…and I mean GOOD. John allowed Mike to live there for 1 month until he got back on his feet. Mike somehow managed to find another job out-of-state that supposedly paid big money. Let everyone know, and one day, just left.

John and I are hanging out – I treated him and his kid to dinner, so we decide to go back to his apt and play some Dreamcast game. He realizes that the game is missing. Okay. Cool. Find it later. We go to look for ANOTHER game and a movie…both of them are missing. At this point, we realize what’s going on. Now, the problem is, he has TONS of movies and games that he’s collected over the years, so he doesn’t know what’s missing until he goes to look for it.

Turns out that Mike screwed a few of our mutual friends over. He managed to borrow things from them and never return the things…most of which most likely ended up pawned for gas-money. He began to spend an upwards of $60 of week at a strip club. Maybe more. He now owes John a sizeable amount of money.

To this day, John STILL manages (on a near daily basis) to point out games and movies that are still missing….it’s like a gift that keeps on effin’ him over. He gets an urge to play (random game/movie) and it’s not there. Particularly missing are quite a few out-of-print movies.

Additionally, Mike left John backed up on rent and utilities. And he borrow things from friends and never returned them.

What's so fucked up is that with all the bad roomie stories there are, the good roomies go through hell and never seem to find one another.

Man, that last story really sucks. I was thinking when I finally move out again, I'd get a random roomate. I can see from these stories it's like playing russian roulette. Looks like when I move out, it'll have to be alone like last time.

The moral of the story is "security deposit." Nice people get fucked.

Frog, I know how you feel. I went through something very similar a few years back, and fear I may be about to go through something like it again (with my brother no less). The only thing I can say is, do what you can to get your money back, but don't carry the anger at getting dicked over like that around, because no good can really come of it. I know I spent a lot of time letting it fuck with me, and to no end. Just move on and write it off as a cost of learning.

It's not that he just couldn't or wouldn't pay me. He deliberately scammed me, and skipped town. Robbed me like I was a complete stranger. If he just said "Hey, I can't pay you" at the beginning of the month so I would have time to find someone to pick up the rent, it wouldn't be nearly so bad. But that's a real scumbag maneuver that he pulled.

Turns out that Mike screwed a few of our mutual friends over. He managed to borrow things from them and never return the thingsÉmost of which most likely ended up pawned for gas-money. He began to spend an upwards of $60 of week at a strip club. Maybe more. He now owes John a sizeable amount of money.

Additionally, Mike left John backed up on rent and utilities. And he borrow things from friends and never returned them.

Totally agree here. Its amazing that people would do stuff like that to their friends. Money changes people and friendships, its best to avoid it if possible. If you are a friends only hope, make sure you write out some sort of document, and have them sign. Because if they are gonna fuck you over and not pay you, then you may as well fuck them back because it wasnt worth it in the first place.

He had a contract at one point, but it has since expired. But yeah, I don't intend to file suit for more than what you just said (which is still substantial). His agreement to pay me $650 on Mar 11 was clearly spelled out and witnessed by my other roommate.

Well done, Frog. Kick his ass hardcore. With the SS# and that myspace account, I'd say it's very likely you'll get restitution from all of this.

I can't comment on how to use the SS# to your advantage. The only thing that pops into my head is open a credit card in his name, but that's just foolish.

The goal being not to get in trouble with the law yourself, of course.

Though, if his SSN somehow, I dunno, found itself written on scraps of paper and spread out over town, well, that'd be a damn shame.
