By this logic, if someone is drunk, it's not their fault for driving, either, since they weren't in the right state of mind to be making that decision.

People do dumb shit that they sometimes regret when they're drunk. They might make decisions they might not have made otherwise. But they can make decisions. A drunk girl can consent, and she can refuse as well. Just because it tilts the odds doesn't mean it's rape if she wishes she didn't do it in the morning.

Nick's line of thinking is half-stupid and half-valid. Yes, rape and all that shit remains illegal no matter what the context, but when you do stupid shit like get completely trashed in a room full of strangers, expect consequences. Everyone has the freedom to be stupid, but if you're not responsible enough to handle the freedom then you're probably going to wind up hurting yourself or someone else.

And I am not in support of creating more laws to protect people from their own stupidity. +1 Darwinism imo. The kid who eats too many marbles doesn't grow up to have kids of his own.

Agreed, but thats what society leads to, the least responsible and ethical taking the most benefits burdening the most people possible.

Those assholes who sleep with everyone and produce abuncha children who won't get an education and will breed the same for generations to come? Those are the ultimate controllers of our democracy. Makes me wonder about fascism or a meritocracy as a viable alternative.

Also, I'm curious, if a sober woman has sex with a drunk man, can he claim rape? Why wouldn't the same logic apply? And if they're both drunk wouldn't it be null and void?

Well thats the real kicker about the article is the double standard goes completely unmentioned. I don't care about women rights, but don't go around throwing double standards at me if you are going to fight the fight.
