Also, the law tends to not to penalize anything less than murder with death, because penalizing lesser crimes with death would create a very strong incentive for violent criminal to kill their victims to cover their tracks.
I gotta say, burg's 100% right on this.
Beyond even the incentive reason, I'm pretty on the fence about the death penalty, but anything less than taking a life should never be met with death.
