Ahmed Ghailani was convicted in federal "civilian" court of one count of conspiracy to blow up a government building, and acquitted of over 280 counts of murder and conspiracy related to the Kenya and Tanzania bombings in 2008. For that offense, he will receive a sentence of 20 years to life. Sounds like a victory for Eric Holder and DOJ. How, exactly, did they "dick up" this proceeding?
Perhaps you are upset that the judge excluded the testimony of a key witness because the Government illegally tortured Ghailani to obtain the witness's identity. But the same result would have been reached in a military tribunal, where involuntarily coerced statements and evidence derived therefrom are not admissible. So even if Holder had disregarded the Constitution, as you would have had him do, and had him tried before a military tribunal, the result would have been the same. See Rule 304(a)(1) and (5) of the Manual for Military Commissions.
Or perhaps you would prefer that the executive simply detain him indefinitely, without trial, or even after an acquittal, as the Administration has previously suggested it would do under the 2001 Authorization for the Use of Military Force (AUMF).
In sum, the Government managed to convict a terrorist by staying within the Constitution and our laws. And hey, even if they failed to convict, they would have detained him anyway.
Win win.
