I didn't say thats the reason they kept it. But the new rules were all enacted in what, August? They couldn't manufacture enough pads for the NHL and AHL that fast.
I will admit that the rule was put in to stop players like Brodeur and Belfour from being a third defenseman who also had the benefit of being immune to physical contact. If goalies were fair game hitting wise outside the crease and weren't allowed to pass the puck past a certain point i'd have no problem getting rid of the Brodeur rule.
Prior to 1948-'49, the NHL passed a rule prohibiting goalies to act as captain or assistants in what could be called the 'Durnan Rule.'

No, Bettman would have never gone for that rule, because it actually makes sense. And absolutely nothing done during the lockout improved the game one iota.
I didn't know exactly when the rule happened but it looks like I had the goalie no captain rule right.
