He could win the one against Microsoft, even if in the EULA it states they aren't responsible for mechanical failures, you can't get to the EULA without opening the box, and at that point it's too late to disagree and return it.
The one against Nintendo has no traction at all though, and admitting he uses HBC will likely come back to bite him in the ass.
