Only because anyone can call so they need to cover their ass. It varies from state to state. Here in New Jersey, you can tape someone all you want. In New York, you have to tell them you're recording. Not sure about California.Quote:

Up here if you call someone and they harass you they can't get in trouble. Because you initiated it. Also continuing a phone call you know is being moderated makes it consensual.

Federal law says that only one member of the phone conversation has to be aware they're being recorded. However, there are state laws as well, and they vary. The whole thing is goofy.
Anyway, I'm torn about all this. As far as the whole "ARE YOU A JEW?!?" thing went back in the day, that was A) crazy, and B) said in public to a public official, so it should be, like, public. But this was a phone conversation where Mel was unaware that he was being recorded (if he knew, then he's even crazier than I thought). Yeah, he's acting like a total fucknut, but you'd be suprised how many of your friends and relatives act exactly like this when they think they're having a heated private conversation with someone who may or may not be pushing their buttons. And that's the other thing- this conversation DOESN'T pick up right at the start; the ball's already rolling. I'd like to hear how the phone call began, exactly. Notice how calm she's remaining the whole time- it's fishy.
I'm not defending Mel...the dude clearly has some really fucked-up, deep-rooted problems, but I don't think airing them like this is fair. If he was beating her ass then the bitch should have just called the cops. That said, Mel's right about one thing: fake tits ARE gross as shit.
BTW, I wonder how Mel's pal Danny Glover is liking the whole "pack of niggers" comment?
The tapes are doctored, pasted together from several conversations and with parts of Oksana's dialog removed. They're also professionally recorded for the explicit purpose of revenge (and now allegedly extortion). She is calm because she knows exactly what the fuck she is doing.Quote:

The forensic analyst who was looking in to the tape said it had been doctored. Now the dentist is saying the photo released was also Photoshopped and the damage was not that severe. They are questioning whether or not Mel actually hit her now.
We already knew Mel was a fly-off-the-handle loud mouth. Then we knew he was a loud mouth racist during his arrest. But Oksana's believability is in question now because of these developments in the investigation. If she's manipulating data nothing she says can truly be believed.Quote:

Mel was not trying to say something to hurt a black person he was mad at, he was casually throwing it out in a dehumanizing way when it had really nothing to do with what he was talking about, which says to me that he probably talks like that all the time and thinks that way too.
