Of all the things to call piracy I don't know that downloading a primarily British show with no DVDs and no plans to ever release them or syndicate in the US would count, but ok.
If you don't have IFC (hell even if you do, according to their schedule they didn't air a single episode of this in all of April) and only use Netflix you'll probably just never see this show.
The pilot was definitely much better, but I don't even think it was the casting as much as having to re-shoot everything and robbing it of a lot of its spontaneity in the process. Like the sales pitch in the restaurant, Dave had a very minor part in but that scene wasn't as funny because they were stuck trying to recapture something.
So it's not really an issue after that.
Some of the best scenes in the pilot were really cut down for the first episode.
It's definitely worth it to watch both.
