If you were to sue me from getting food poisoning, you'd win. Restaurants refuse rare to shield themselves from lawsuits. I'm doing it since I believe in our food, know how to prepare it, and believe that people who are ordering rare know the risks involved. And there are risks. I'd wager you've had food poisoning dozens of times without knowing it if you're eating rare meat on the regular. But in the odds world, it's unlikely you'll get anything more than an upset stomach. Probably not even enough to throw up.
