I'm fine with small purchases. $5 VC release et all. If this were on steam, PSN or Live I'd have no argument. Nintendo's stance of tough shit if something happens to your console keeps me from buying it on eShop.
Unlike every other content provider in the world, Nintendo doesn't have an account system. Everything you purchase is tied directly to your console. If you purchase a new console, both consoles need to be present for you to perform a system transfer and move all your licenses together from one to the other. This makes it a hassle to replace broken systems and makes it impossible to trade in consoles. The other side of the coin is that anyone buying a used console gets to play all the games attached to it, which is weird as fuck. If your Nintendo handheld is lost or stolen, a very real possibility, it's a crap shoot whether or not the Indian dude on customer support will transfer your licenses for you, give you credit to buy most of your stuff back, or tell you to fuck off. There have been a lot of horror stories of people losing their content because of this, most notably some dude who had bought thousands of dollars worth of VC games and was told to fuck off until Kotaku and the othere blog news sites ran with the story.
Does that make more sense now?
It's the nightmare scenario of DD, basically.
PS - you're limited to 5 lifetime system transfers.

Nintendo is even bragging about how much money they're making by cutting out all the usual costs and by undershipping certain games and charging MSRP on the eShop. I don't want to support that shit even a tiny bit.
