I'm pretty sure the law is on Jeff's side on this one. He should negotiate or fight. I know that's a tough proposition, but there's more than enough legal precedent that clone games are legal.

He's in the right but legal fights cost serious amounts of money. He's already thrown a couple thousand at it and that's as much as he can afford.
Fuck Atari. From that link, one of the things they want is to have Minter "sign papers basically saying I can never make a Tempest style game ever again." Copyright trolling is one thing, but that's pure cuntishness beyond any possible justification. Also from that link is an explanation of the the Tempest 2000/Tempest X situation and how it relates as legal precedent to TxK.
Yeah, that's so far beyond the usual fuckery that goes on in this situation. Usually it doesn't go much further than "Kindly change the name and characters please," but since there isn't even that much going on here, it's just pure bullshit.

I just don't understand why this is all coming to a head now. The game came out on Vita a year ago. There's been platform announcements and other kinds of marketing from then until now. Why is this determination being made in March 2015 instead of March 2014, or any time since then?
