Killing him isn't even eye for an eye though. If he's killed how would that be eye for an eye? Let the punishment fit the crime. He stole people's money and ruined their lives, take away his money and ruin his life. Sure it will be a comfortable prison but he has no freedom, no more yachts, no more power, nothing.
Hammurabi aside, the punishment wouldn't be eye for an eye in the Jewish Mosaic law as an example. He would have been ordered by the Israelite chieftans to pay back all he stole, even property directly to the victims.
Babylonian punishment was far more harsh and the Hammurabi code was more designed to terrify than deter.
