AG- how tall are you? I love love love those brown boots, but I think anyone under 5'7 is going to have trouble, even with skinny jeans. (I hate to say that because I loooooooove those types of boots but they fail on me.)
Now, let's talk about those black weird ones. I LOVE THEM. A ton. I think if you are a bit on the shorter side, they will be massive win, because they are really strange, but sleek enough to work. My vote is for second pair, hands down.

I want to make a punk rock tee formal. Can I do that?
Here's the thing: I have a formal party that I may have to attend in a bit and I wanted to look out of place. It's black tie so I plan on wearing a black bowtie, renting a slim tux jacket and skinny tux pants, and buying a new Ramones tee that's a smaller size so it's much more snug.
And no, I won't get the boot if I go like this.

If your formal party in a bit is after 12am, go with the standard sports coat. pants, shirt look. Everybody else will be. All Black Tie's expect about a 60% conformity rate anyway.
If by a bit you mean a couple of weeks, just wear a classy white shirt, the bowtie, and a nice coat and shed the tie after entry.

Heh, damn, I am 5'3 too! That's why I love wearing mega high heels. As for skinny jeans debate, my legs aren't that chunky anymore and my stomach is flat so no muffin top. I don't wear skin tight jeans but they are the skinny cut. Next time I wear some I will take a pic and post it on here.
