Because they didn't actually pay anyone for the rights to their story so lawyers probably wouldn't let them.

I think you can do that as long as you're not using real names and it has a disclaimer and all. There are lots of movies that fictionalize real events.

As long as there's nothing more specific than "Bearded man with fanny pack on bus" I think it's vague enough that you can't really sue over it. Even though we all know what it is.
