Yes, but I can understand the point of the law. If you were legally allowed to kill anyone who broke into your home, it would be very easy to invite someone over to your house, shoot them in the face, and then smash a window (or tell the police they entered the unlocked front door uninvited) and get off scott-free.

And if you kill someone who has broken into your home, you're probably not going to face serious charges unless you shoot them in the back or something.

Tort reform is long overdue in the US, but it's a seperate issue.

Heh, this reminds me of when I was in high school, for some reason in my economics class my teacher was discussing with us EXACTLY what you needed to do to kill some one who broke into your house and get off scott free with the local law enforcement.

In retrospect, that was pretty fucked up.

Actually, as I understand it (and anybody who can show me something that proves me wrong please do so), in Texas if someone breaks into your house, you are legally allowed to use deadly force. It doesn't matter if said person is threatening you or not. *shrug* Personally, I'd end the person before they knew I was there simply because I can't guarantee they won't harm me. They've already attacked me per se by breaking into my home; I'm not going to give them the benefit of the doubt that they are not going to just stop there. In for a penny, in for a pound.

That said, I do think ol' Peter went a bit overboard there. He should have chased them, but call the police while doing so in order to have THEM apprehend them.

In Texas it is perfectly legal to protect property with deadly force. I'm not up to date with all the laws in the U.S. but I have a feeling there are some other Southern states that probably have the same law.
