This new job of mine is making up their own laws

The quick version:

I started another job about three weeks ago. My first full check I accumulated about 49 hours. I didn't get paid time and a half for overtime. Maybe a mistake? I hoped. The Director of Operations was going to be out of town for a week so I didn't get a chance to bring it up until he got back. The next check I did about 45 hours, again, no overtime.

I bring it up yesterday, says to email him the information, and he'll find out what's going on with the owners. Today I was told basically, "the company doesn't pay overtime unless it is 50 hours or more."

Yeah, I'm I think I'm going to have to give the U.S. Dept. of Labor a call tomorrow.

Good job, theres no reason to take shit.

Are you under salary? The job I'm working at now didnt pay overtime if you were salaried. Now that we were bought-out and merged with BMG Columbia House, we now get overtime pay since BMG employees got paid overtime and we're pretty much following their policies.

I'm being paid an hourly wage.

Not to mention you can't just not pay overtime if you don't exceed a certain hour.

You either pay overtime or you don't. Not "Overtime between 40-50 hours is unaccounted for"

Quit.

It's a fairly new company with small number of employees. I've been told numerous times "this company is going places" and "while you may have to sacrifice now, in the long run it'll all work out."

It certainly has the potential to grow, but in the end, will my "reward" be worth the hassle that I"m going through right now? It could go either way.

P.S. There is a long story to this which I probably don't need to get into.

P.P.S. The wage is unacceptable and the commute is way too long.

If they can't afford to pay their employee's overtime their employee's shouldn't be working fucking overtime. It's that simple.

If you take the lay down on OT now you are letting them know that it is OK to steal from you. What makes you think the "reward" will be worth it in the end if they are trying to long dick you on your first month?

Make a stand! Demand your OT and the retro OT or tell them to fuck off. Mark my words, you take the lay down now and you'll always be their doormat.

You know, I was in the middle of washing my face and it just came to me. I think I'm just going to call them up in the morning and say "sorry, things aren't going to work out between us." The end.

Or I could e-mail them now and sleep in.

Or I could do both.
