Are you really okay with executing someone who hasn't committed a crime? After all, what has this guy done but make stupid videos where he talked up radical islamists? Certainly he's advocating harm against America and United States citizens, but that's not a crime is it? Unless there's evidence that he's a party to violence then I don't see how we could reasonably condemn him to death.
Time for a change
It's a tricky subject, and the very few federal prosecutions for treason all took place within very specific historical contexts (not surprisingly), just like we now have a current context ("global war on terror," etc.) But you're touching on a point that's partly correct insofar as certain types of "anti-American" speech alone may not satisfiy the elements of treason. The very short answer is that it requires so-called specific intent to commit some act that constitutes "levying war" on the United States," "adhering" to the enemies of the United States, or giving aid and comfort to said enemies, either within or out of the country. There's also the "two witness" requirement under the Constitution. From what I've read, the gov't seems to think it has a very good case (not that that is necessarily reliable), but it sure sounds like they've got something more in their pocket than just some lame videos.
