When I was younger, I bought a game from Best Buy and when I opened it up at home there was a shark DVD rented from Blockbuster inside.
When I took it back, they didn't believe me, but my dad stepped in and got pissed off at the little shit behind the counter, so they gave me a new one.
I knew before I bought it that the shrink wrapping felt weird, but I didn't look into it enough before buying it. I guess someone at the warehouse snagged the game and wrapped it back up. But the moral of the story is: scaring the teenage bastard behind the counter can work sometimes.
This was true for titles appearing on the PS2, but the wrapping used on PS3 titles isn't shrinkwrap; It has nicely folded wrapping on both ends. I guess you could carefully open one end, slide the case out, remove the game and gently slide it back in; it would be a real bitch to do so.

As long as you don't start to scream or cause a scene, yes. Otherwise, meet the police.
I got a DVD set from Best Buy about a year ago, opened it up, and all the DVDs were missing. Perfectly shrinkwrapped and there was nothing inside. BB was more than a royal pain about it.
If you fail at the store you actually got something from, just go to target. I had to return the band of brothers set as one of the discs was ruined right out of the box. They didn't even open it up to look, they just agve me a new one.
