  4. But that would toss out the appeals system for death penalities. As it stands now at least in Texas, you get a trial, one appeal by right then you can appeal to the supreme court and they're totally free to ignore that (and they do 95% of the time).

    After that you're pretty much restricted to extraordinary appeals where you can demonstrate that you were actually innocent, pleas for a pardon and such. They're really limited, high burden long shots even if you're ACTUALLY innocent.

    Yes the prisons are overfilled because we've had this war on crime for the last 40 years, where every politician has to campaign on how tough on crime they are, ratcheting up penalties for things like pot possession to prison time and taking sentencing discretion away from the judges with mandatory prison sentences.

    Death penalty cases take forever, and cost a ton because we're so fucking cautious about these things.

    But know this, 98% of all criminals plea out. If you plea out you don't get a trial, nor an appeal unless you can prove you were duped into pleaing out. Even then most of the time unless you figure THAT out in 30 days and request a new trial you're completely fucked and restricted to a habeas appeal on actual innocence and that will only work if the judge, or prosecutor will admit they were wrong.

  5. Texas is a shitpile who needs the fed's to come in and regulate their entire judicial system. Other than that I am pro execution and against rehabilitation for multiple offense offenders.

  6. Actually Texas' criminal system is explicitly modeled after the federal system at every turn because those are the minimums. Texas law makers take great pains to mimic the fed system because they want to be as tough on crime as they are, except the feds usually deal with the federal cases.

    Asking the feds to come in and regulate it would do very little except make the prisons a bit cleaner, less corrupt and possibly more willing to hear appeals of actual innocence.

    Are you even serious here? I may be "modeled after ol' grandad" but they parted paths years ago. Texas' legal representation from cop to judge are bigger criminals than 1/2 the people they prosecute. If it were a third world country, we would charge it with war crimes.

    Did you vote for a tough on crime politician ever? Then this system is explicitly your fault. It is those people who refuse to establish a well funded public defender's office.

    Yet here you are wanting to execute people at the end of the trials, then claiming the system is fucked and needs reform, and need to do justice.

    Again blame the voters, we elect judges here. The injustice here is the injustice people have chosen.

    I don't consider a mayor or govenor because he's "tough on crime" it's all bullshit. It's the judge. And if he's getting bad press or it's an election year, you're fucked in the head if you think he's being fair.

    Our local judge was being considered for election to a federal post this year, he then went out and charge more people with crimes than ever before in this area.

    Again, our system is the greatest in the world, but it's an old boy club. If you don't know that yet, I question if you've ever ventured into a courtroom yet.

    Verdicts and penalties are decided at the Oak's Club, not in chambers.
