Maybe this will spark them to add in the hooks for patching into the OS with a firmware update. Though if programmed for it they could have supported patches on MK7 even with out it being a part of the OS. There's a couple of Wii games that support patching.
It's not an unwritable cartridge, there's room there for your game save but probably not enough for a patch. If it was unwritable they'd have to save to the system memory or a memory card and then they'd be able to patch it.
I agree that they should be able to, but it's not a surprise that they can't.

I'd be surprised if it was anyone other than Nintendo. Patching functionality is a requirement these days, especially when you're dealing with an online mode.
